Refund & Cancellation Policy

1. Introduction
This Refund & Cancellation Policy ("Policy") governs all payments made to NestUp.work ("we", "us", "our"), an online platform operated by an independent developer and used by startups and interns ("Users", "you", "your").
By purchasing credits, subscriptions, or paid services ("Paid Features") through our Platform, you acknowledge and agree to this Policy in addition to our Terms and Conditions and Privacy Policy.
This Policy is designed to ensure transparency in transactions, maintain compliance with EU consumer protection laws, Indian financial regulations, and international e-commerce standards, and to safeguard both Users and NestUp against misuse or fraud.
2. Nature of Product and Payments
- NestUp operates on a credit-based model where Users purchase digital credits that can be used to access premium features such as internship postings.
- Credits are a digital service, not a physical or tangible product, and are consumed immediately upon use.
- All payments are processed securely through Stripe, a PCI-DSS compliant payment gateway.
- Stripe acts as the authorized payment processor. NestUp does not collect or store your card, banking, or wallet details.
- All amounts are billed in US Dollars (USD) unless otherwise specified. When paying from outside the US, your bank or card provider may apply currency conversion fees or foreign exchange charges.
3. No-Refund Policy for Digital Credits
⚠️ All purchases of credits or other digital services on NestUp are final and non-refundable.
- Once credits are successfully purchased and added to your account, we are unable to reverse, cancel, or exchange them for cash or other benefits.
- This policy aligns with the EU Consumer Rights Directive (Article 16), which exempts digital goods and services from mandatory refund obligations once delivery has begun with consumer consent.
- Users acknowledge that by confirming a purchase, they expressly waive their right of withdrawal for digital services that are immediately available after payment.
4. Exceptions — When Refunds May Be Considered
Refunds may be processed only in the following exceptional cases:
- Duplicate payment: You were charged twice for the same transaction.
- Technical error: A confirmed payment failed to credit your account due to system malfunction.
- Unauthorized or fraudulent charge: The transaction was made without your consent and verified as fraud by your payment provider.
- Compliance obligation: A refund is required by applicable law, card network, or regulatory authority (e.g., under the Reserve Bank of India or EU consumer protection rules).
Refunds outside of these cases are not permitted.
5. Refund Process
To request a refund under the above exceptions, email hello@nestup.work within 7 calendar days of the transaction.
Include the following details:
- Registered email address
- Payment ID (from Stripe or your confirmation email)
- Transaction date and amount
- Reason for refund request
Once received, our team will:
- Verify the transaction with Stripe
- Validate eligibility based on this Policy
- Respond within 10 business days with a resolution
If approved, the refund will be processed to the original payment method within 7–14 business days, depending on the bank/card issuer.
In case of international transactions, currency conversion rates and intermediary fees may affect the final refunded amount; NestUp bears no responsibility for such variations.
6. Chargebacks and Disputes
- Users are expected to first contact hello@nestup.work to resolve payment-related issues before initiating a chargeback.
- Unwarranted chargebacks (i.e., without first contacting support or contrary to this Policy) may result in account suspension and recovery of disputed amounts.
- In the event of a chargeback or dispute raised through the payment provider, we will submit proof of purchase and service delivery to Stripe and/or the card network.
- Stripe and the respective financial institution will have the final authority on chargeback resolution under their governing laws.
7. Cancellation Policy
- Once payment is completed, credit purchases cannot be cancelled or reversed.
- If you delete your account, any unused credits will automatically expire and will not be refunded or transferred.
- We may cancel or restrict transactions that appear fraudulent, abusive, or in violation of our Terms and Conditions.
- In such cases, refunds (if any) will be determined at our sole discretion and processed according to this Policy.
8. System Errors or Failed Transactions
- If a payment fails but funds are debited from your bank account, Stripe typically reverses the transaction automatically within 5–7 working days.
- If reversal does not occur, contact hello@nestup.work with transaction details. We will coordinate with Stripe to ensure prompt resolution.
- NestUp is not liable for delays caused by bank processing times, network failures, or third-party payment intermediaries.
9. Compliance and Legal Framework
This Policy complies with:
- Reserve Bank of India (RBI) guidelines on payment settlements and refund timelines
- Information Technology Act, 2000 (India)
- Foreign Exchange Management Act (FEMA) for cross-border remittances
- EU Consumer Rights Directive (2011/83/EU) for digital services
- General Data Protection Regulation (GDPR) (EU) for personal data associated with payments
All refunds and disputes are handled transparently and documented to meet auditing and financial compliance requirements.
10. Limitation of Liability
NestUp's liability under this Policy is limited to the amount you paid for the specific transaction in question.
We are not liable for:
- Losses due to incorrect payment details provided by you
- Bank or card network delays
- Exchange rate fluctuations or intermediary charges
- Any indirect, consequential, or incidental damages arising from payment or refund processes
You agree that Stripe, card networks, or financial institutions involved in processing payments are independent third parties and not agents or representatives of NestUp.
11. Governing Law and Jurisdiction
This Policy shall be governed by and interpreted in accordance with the laws of the Republic of Ireland, where NestUp operates.
However, all payments processed through Stripe are additionally subject to the laws and regulations of the United States, including any directives from relevant financial authorities.
Any disputes shall be subject to the exclusive jurisdiction of the courts of Ireland, except where required otherwise under mandatory local laws.
